1. About these Terms

These Terms of Use apply when you access or use www.stardynamic.com.au and its content, forms and features (the Website).

The Website is operated by Bydezign Consulting Pty Ltd (ABN 22 697 376 720, ACN 697 376 720), trading as Star Dynamic Investments (we, us or our). “You” means any person who accesses or uses the Website.

By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

2. Information on the Website

The Website and its content are provided for general information only. They are not tailored to your circumstances and are not a substitute for advice from a suitably qualified professional.

We do not provide financial product advice, credit advice, tax advice or legal advice. We do not recommend or arrange credit. You should obtain independent financial, credit, tax, legal and other professional advice where appropriate before making decisions.

Our services are limited to property strategy assistance. We are not acting as your buyer’s agent and do not provide buyer’s-agent services. Any referral to a buyer’s agent or other provider is subject to section 9.

You are responsible for assessing Website information and deciding whether it is suitable for your circumstances. Property investment involves risks. Property values, rental income, costs, borrowing capacity and market conditions can change, and past performance is not a reliable indicator of future performance.

3. No promised outcomes or reliance

We do not promise that using the Website, our content or our services will produce a particular investment, financial or other outcome.

Examples, projections, calculations or scenario modelling, including modelling produced using Empire Edge, are illustrative and based on assumptions and information available at the time. Actual results may differ materially. They are not guarantees, forecasts or assurances of future performance.

Do not rely on Website content as the sole basis for an investment, borrowing, purchase or other decision. Check relevant information independently and consider your own objectives, financial circumstances and risk tolerance.

4. Services and separate service agreement

We may describe services on the Website, including a Strategy Snapshot for $495 plus GST, a Portfolio Blueprint for $4,495 plus GST, Portfolio Partner for $895 per year or $95 per month (subject to eligibility and the applicable service terms), and a free, no-obligation strategy review. These descriptions are general and may change.

The applicable scope, fees, payment terms, eligibility and other conditions for any paid service are set out in a separate service agreement between you and us. These Terms do not replace, amend or substitute for that agreement. If you engage us, the service agreement governs the services it covers. If there is an inconsistency, the service agreement applies to those services to the extent of the inconsistency.

A Website description, enquiry or booking does not itself engage us to provide a paid service. We will confirm any engagement separately.

5. Enquiries and bookings

You may use Website forms to contact us or request information, and you may be directed to a booking service provided through GoHighLevel (GHL) to make a booking.

You agree to provide information that is accurate and not misleading, and to update it if it changes. Do not submit sensitive personal information through a form unless we specifically request it and explain how to provide it securely.

Bookings may be subject to the booking provider’s own terms and privacy practices. We do not control third-party booking services. A booking request is not confirmed until the relevant confirmation is issued.

We handle personal information in accordance with our Privacy Policy.

6. Permitted and prohibited use

You may use the Website for lawful, personal or business purposes consistent with these Terms. You must not:

• use the Website in breach of any law or another person’s rights;
• submit false, misleading, unlawful, offensive or unauthorised material;
• interfere with the Website, its security or operation, or attempt to gain unauthorised access to any system or data;
• introduce viruses, malicious code or other harmful material;
• scrape, harvest, copy or extract Website content or data using automated means without our prior written consent;
• reproduce, modify, distribute, publish, sell or commercially exploit Website content except as permitted by law or with our prior written consent; or
• use the Website or its content to misrepresent your relationship with us or suggest that we endorse you or your services.

We may restrict or suspend access where reasonably necessary to protect the Website, our users or our rights, or to address unlawful or prohibited use.

7. Intellectual property

Unless stated otherwise, we or our licensors own or license the Website and its content, including text, graphics, branding, designs, documents, models and materials. All rights are reserved.

The Three-Pillar Portfolio guide and its content are protected by intellectual property laws. You may access or download it only for your personal, non-commercial use, subject to any additional terms provided with the guide. You must not reproduce, adapt, distribute or commercially use the guide or other Website content without our prior written consent, except where permitted by law.

You may print or save a reasonable copy of Website material for your own personal reference, provided you do not remove any copyright or other proprietary notice.

8. Website availability and warranties

We aim to keep the Website available and its content accurate, but we do not guarantee uninterrupted access, error-free operation, completeness, accuracy or currency. Website content may be changed or removed without notice.

To the extent permitted by law, the Website and its content are provided without warranties or guarantees not expressly stated in these Terms. Nothing in these Terms excludes, restricts or modifies a right, guarantee or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

9. Third-party websites, providers and referrals

The Website may link to third-party websites or services, including booking services, buyer’s agents and referral partners. Those third parties operate independently and may have their own terms, privacy policies, fees and practices. We do not control or endorse their content or services merely because we link to them or refer you to them.

We may receive a referral fee or other benefit if you are referred to, or engage, a buyer’s agent or another provider. Where relevant, we will disclose this. A referral is not a guarantee that a provider or service is suitable for you. Make your own enquiries, consider any conflicts or fees, and decide independently whether to engage a provider.

Your dealings with a third party are between you and that third party. To the extent permitted by law, we are not responsible for third-party websites, services, acts or omissions.

10. Testimonials and examples

Testimonials, case studies and examples on the Website describe individual experiences or illustrative scenarios. They are not typical-result claims or promises that you will achieve the same or similar outcomes. Results depend on your circumstances and other factors, including market conditions and decisions made by you and others.

11. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, we exclude liability for loss or damage arising from your use of, or inability to use, the Website or your reliance on its content. This does not apply to liability that cannot lawfully be excluded. You remain responsible for your decisions and for obtaining advice appropriate to your circumstances.

If a law permits us to limit our liability for a breach of a consumer guarantee, our liability is limited to the extent and in the manner permitted by that law. For services, this may include supplying the services again or paying the cost of having the services supplied again. This clause does not limit any remedy that the law requires us to provide.

12. Changes to the Website or these Terms

We may change the Website or these Terms from time to time. We will publish the current Terms on the Website and update the last updated date. Changes apply from publication unless we state otherwise. Your continued use of the Website after a change is published means you accept the updated Terms. If you do not accept them, stop using the Website.

Changes to these Terms do not vary a separate service agreement unless that agreement allows the change or you otherwise agree in writing.

13. Governing law

These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from them.

15. Consumer rights

Nothing in these Terms is intended to exclude, restrict or modify your rights under the Australian Consumer Law or any other rights that cannot lawfully be excluded, restricted or modified. If any provision of these Terms is unenforceable, that provision is severed to the extent necessary, and the remaining provisions continue to apply.
